The law should protect the naive gambler who has incomplete information concerning payout tables and has been consuming the free drinks. It is the casino that provides the incessant noise, the alluring displays, the free drinks and it is the casino that made the mistake and can bear the loss. The industry runs on trust that the casino will pay off when it loses for it is clearly known the casino will take the players money when it wins. The machine did not 'malfunction' in the usual and customary use of that word. The casino put a machine out there that was as a result of human error set to payoff at a very high value. An expert player would have known the jackpot was excessive but the law should protect the average player who is ignorant of payout tables and return on investment calculations.
